How Now Brown Cow?

The Cape Cod Times has weighed in on Klimm's departure.

Their take on the deal is, "Don't take it." They conclude, "Let the November elections become a referendum on Klimm's performance. If the voters are not happy with his services, re-elect those who booted Klimm. If they are happy with Klimm, boot the councilors who voted him out."

This could get ugly.

In case you are curious, it seems that the mutiny we witnessed in Town Hall last week was part of a grand plan after all. You wouldn't know it from the explanations offered to the public by the Crocker Six, but John Norman definitely thinks there is a plan. He said as much in his now famous "fast ball" speech:

I know there are folks who think life is like baseball. But, when trying to explain the inexplicable I prefer the Facebook status, "It's complicated." And, it's going to get a whole lot more complicated, if Klimm refuses to accept the offer made by the Council to step down.

Klimm had his chance to run for mayor. He passed on the opportunity. The idea that he can now run Cullum, Hersey/Krau, and Crow as proxies is absurd.

Hyannis Water dodged restrictions...

The Hyannis Water Board’s best laid plans won’t be necessary, as the state Department of Environmental Protection provided the final approval for the Maher wells to go back on-line.

At a special July 27 meeting, the board had made contingencies for mandatory water restrictions in the event the wells, which supply roughly 25 percent of the system’s water, were unavailable for the busy July 4 weekend.

Water Division Supervisor Hans Keijser said that the DEP approval to use the wells was given this morning (June 28) and no restrictions will be required.

1. Why is it surprising that the Times would support the biggest moron in town, Klimm?
2. Sean Gonsalves does not know his ass from his elbow.
3. Klimm could not get elected Mayor in this town if he paid the voters. The only ones who support him are all the hack losers who he created the high paying cushy jobs for thus wasting our tax dollars.
4. The councillors who finally voted him out only did so because they KNOW that the town has been sliding downhill now for years, and blaming him (they think) will let them off the hook. This is really how stupid these six are!
5. The other five losers who wanted to keep Klimm only wanted this because this is their only hope of convincing voters in town that all is well in Happystable when in fact things have been dreadful for a long time.
6. The waste, corruption, incompetence and misuse of our tax money has been rampant for years.
7. John Norman is as clueless as Gonsalves.

Is this situation an attempt to force votes of confidence or "loyalty  oaths" from various groups in town such as civic organizations? It certainly seems to put the Crocker Six in a bad light going into elections. If the six can't produce tangible signs of support from the public or name players it makes them seem arbitrary and petty. In the end Klimm may emerge with his power consolidated even more.

I wouldn't count on that. If someone were to take a REAL TRUE 100% poll of voters and taxpayers in town on what they think of Klimm's performance over the past five plus years, he would get his ass handed to him. The big problem is the CCTimes and the Patriot patronizing this moron. John Klimm is nothing but an egositical fraud in my opinion and the asses on the town council know this but are too afraid to admit it because once they do, they will be merely admitting that many in town have their number for how long now? And this includes that author of this blog, Gary Lopez and many others in town. We have all know their game for years now. They are all losers and frauds as far as I am concerned. Nothing but a bunch of egotistical morons. They all deserve each other. The only thing Crocker and company did recently was admit we have been RIGHT ON all along! The other asses on the council Chirigotis, Barry, Rugo, Barton, Dagwan, Joakim and Tinsley are simply clueless and will never admit their mistakes. As far as I am concerned, we only solved half he battle by dumping the idiot Klimm. Now we need to dum ALL these asses who call themselves town councillors. I sent in a couple letters to the Patriot and Barnstable Enterprise stating just this. Let's see if they print it.

I'm not seeing or hearing any support for Klimm. Sure, there were a couple of letters in the CCT, but not enough to fill a page. Folks are upset at the tactless manner in which he was disposed, but I don't know anyone who plans to do anything to help Klimm regain his position.

The truth is that John lost the support of the business community with his dictatorial Planning Board and Growth Management Department. Folks want growth - any growth - and they don't want the management Klimm is offering.

One person in my neighborhood accused me of hating Klimm. I explained that I don't hate anyone. I just don't favor Klimm singular view of Hyannis. Hyannis has many voices and Klimm represented very few of them. My neighbor accepted this answer.

That was one person.

Everyone else I know couldn't care less if Klimm stays or goes. He's not part of our lives. He's done nothing for us.

John Klimm still wants to take over the privat roads in Barnstable, even though the voters sent him a A LARGE MAJORITY NO VOTE in the last elections on this issue. 
What Klimm doesn`t understand, those of us who live on private roads pay our excise taxes, property taxes to the town, we property owners on private roads should have our roads repaired the same as town own roads have theirs. If Klimm doesn`t want to repaire private roads then we should only have to pay a small percentage of property tax to barnstable, and zero excise tax to barnstable.

Section 4-7. Removal of Town Manager.

The town council by affirmative vote of a majority of the full council may vote to terminate,
remove or suspend the town manager from office in accordance with the following procedure:

Prior to removal or termination the town council shall adopt a preliminary resolution of
removal by the affirmative vote of a majority of the full council. The preliminary resolution
may suspend the town manager for a period not to exceed thirty days. A copy of the resolution
shall be delivered to the town manager forthwith.

If so requested by the town manager, town council shall provide a written statement setting
forth the reasons for the removal or termination.

Within five days after the receipt of the preliminary resolution, the town manager may request a
public hearing by filing a written request for such hearing with the town council. If such a
hearing is requested, the hearing shall be held at a meeting of the town council not later than
twenty days from the date of request. At such hearing the town manager shall be entitled to
address the town council and make comments related to the preliminary resolution.

If a public hearing has not been requested by the town manager, the town council may adopt a
final resolution of removal, which may be effective immediately, by <span>the affirmative vote of a
majority of the full council
</span> at any time after ten days following the date of delivery of a copy of
the preliminary resolution to the town manager. If the town manager requests a public hearing,
the town council may, at the conclusion of the hearing or within five days of the conclusion of
the hearing, adopt a final resolution of removal by <span>an affirmative vote of majority of the full
council.
</span>

The town council may suspend by an affirmative <span>vote of the majority of the full council</span> the
town manager pending and during any public hearing as requested by the town manager. The
town manager shall continue to receive a salary until the final date of removal shall become
effective unless provided otherwise. The action of the town council in terminating, removing or
suspending the town manager shall be final.

From reading the above, I have to wonder if last Thursday's vote is valid, only 11 out of 13 councilors were in attendence which means the full council was not present.

On channel-18 this morning , Nick was interviewing Mark Milne the towns finance director. Mark said to Nick: the new Hyannis Youth Center it`s revenues are down no one is renting Ice Time. The Hyannis Youth Center had to melt one of the ice in the center. Mark also said, with revenues down they had to scale back on spending, and the town took money out of its general funds to give to the Hyannis Youth Center so it can pay its bills.

Mark said: That golfing revenues are way down, Old Barnstable Fair Grounds Golf Course has paid off its bond. The staff of the golf course wanted to take the bond money and repaire the OBFG golf course, revenues are down so much the golf course has to use this money to pay for the help.

The town should look into privatizing both golf courses, and the Hyannis Youth Center.
The state of Massachusetts owns 13-ice rinks, everyone of their ice rinks are privatized. The state could not afford operate their rinks.
It is the same in golf courses that are owned by towns and cities the majority of the golf courses are privatized. Boston privatized their golf courses, the city saved hundreds of thousands of dollars each year operations, and also Boston gets a lease fee and a percentage
of the whole business. I call that a smart Mayor taking care of its HUB/city of Boston.
John Klimm always says Hyannis is the hub of Cape Cod, do you think he can be as smart as the mayor of Boston. Hey JOHN KLIMM PRIVATIZE BARNSTABLES GOLF COURSES OPERATIONS, and PRIVATIZE THE HYANNIS YOUTH CENTER, maybe those 6 councilors will think you are trying to do better at your job.

Moving money to the HYCC so they can pay their bills? Wasn't it a great idea to knock down homes and remove them from the tax rolls to make them a parking lot and to have weeds growing on them? The rink is dead- weeds growing, the brick walkway is already chipping, the staff is miserable after being over worked, layed-off or furloughed.
The facade of wonder is cracking.
How about the weeds on the park on Main Street next to the Bank of America? There are so many that even the homeless don't hang out there any more.
And potholes...that is a vast and deep subject.

To "terminate" the Town manager would require a majority vote of the full council; to renegotiate his contract, as was done, only requires a makority vote of those Councilors present at the meeting, assuming there is a quorum.  If the Town Manager chooses to not sign the agreement it would require then require seven votes to terminate him.  John is far from gone.

It will be interesting to see what the two councilors who took a walk end up doing now that Demetrius has, by his own actions, taken himself out of contention to be the next Town Manager.

The key in section 4-7 is exactly how the word remove is defined since John Klimm has been or will be removed from office. If you read the full text of  section 4 of the town charter, every vote on the position of town manager requires a full council in attendence.

As for the two absent councilors, they were both off Cape and expected that Jan Barton's request for a postponement would be honored to allow them to be in attendence.

The Enterprise has an article on the proKlimm group, delightfully named the Barnstable Coalition For Fair Government. Apparently the "Barnstable Coalition For Everything Clean and Decent" was considered over the top. "Barnstable Coalition For Some Timely Payback" gave the wrong spin. All the years they have been in power, the Centerville\Klimm junta has always been known for its total commitment to fair government. It's hard to have any sympathy for any of the players in this sordid game.

Great. Maybe we might just get another ANTI-KLIMM group. As for ALL the newspaper folks, why don't they go stand at the town DUMP and take a poll there like we have on so many occasions. Go ask a few thousand of the residents and taxpayers there just what they think of Klimm AND THE COUNCIL. I can tell you firsthand that it is not pretty. We have been there on numerous occasions and some of the things people have said is not even printable on any post anywhere. The TRUTH is that most people KNOW that Klimm is an asswipe and they also know that most of the councillors are nothing but a bunch of losers. If they don't believe this then go to the dump and ask those people there. Klimm is a fraud as far as I am concerned. Among other things he is a liar and  couldn't manage a dog pound. What we have running our town are 14 LOSERS--- Klimm and his 13 puppets.

And to the papers, ever heard of a NO CONFIDENCE vote? This is what this is. If we had a poll from 1000 voters in this town, my bet is 80% or better would have Klimm's ass tossed out tomorrow. THIS is what the truth is, not the propaganda that these idiots from the newspapers write. I sent in an ANTI-KLIMM letter to the Patriot and they would not print it. Anyone surprised?

I have a letter dated November 1, 2002 from Manager John C. Klimm to the then CEO of Connecticut Water Marshall T. Chiaraluce in which Klimm offered them $ 3,500,000 for the Barnstable Water Company that would include all of the assets "of both Barlaco and the Barnstable Water Company. So there was Klimm in November of 2002 writing to Chiaraluce offering them the $ 3.5M for the water company.....

Then on June 8, 2004 Klimm writes back to Chiaraluce wherein he (Klimm) referenced that he proposed a $10 million cash price.

So the million dollar question is how and why in God's name did Klimm go from offering $ 3.5M to $ 10M PLUS ANOTHER $ 1M for the Barlaco land in 19 months. Count em, from November of 2002 till June 8th is some 19 months. So just what prompted Klimm to up his offer from $ 3.5M to $ 11M in 19 months.

And then of course on October 21st in 2004, some four months later Chiaraluce wrote back to Klimm in a letter that appears to come from his home address ND HIS FIRST LINE READS,

Dear John:

I am sending this as a personal letter since I do not want it made part of the record of communication between us.


He then went on to write to Klimm that "we would be willing to sell you all of the land in BARLACO (109 acres) for the $ 1,000,000 you offered and treat the transaction as a bargian sale for federal tax purposes on our books.

So you see good friends, Klimm has never answered some questions we had for him because he is too damn arrogant. It is reprehensible that ANYONE would be secretly negotiating an $ 11M deal with PUBLIC TAXPAYER MONEY, but this asswipe did exactly that!

It is time for a major league investigation into Klimm and the asses on the town council. And as for Chirigotis, he is nothing but a moron.

Also, I added a poll (top right). If you are from Hyannis, let me know who you support in the upcoming race. So far, no one from the 3rd has stepped up to challenge Munafo. With all the talk about Klimm, you'd think someone - presumably a Klimm supporter - would step forward.

Unfortunately for John, I'm not hearing a lot of support for him in Hyannis (and, I don't see anyone overly upset by Munafo's vote of no confidence in the Town Manager.

If anyone wants to have some fun, there is a meeting on Thursday night at the Steamship Bldg on School St in Hyannis at 7 pm. Mr. illustrious Asst Town Mgr Tom Lynch is going to give his presentation on why the town should waste a ton more of our money on buying that piece of land in West Yarmouth. It seems that here we go again. SOMEONE's PALS must need a dock so the town clowns in barnstable are going to use our money to buy LAND IN ANOTHER TOWN. Nice eh?

I plan to be there and have a few things to say to the major league moron Lynch. This guy is the biggest loser this town has ever seen. Besides, I am not sure if I have ever heard this clwon say one word-- ever--- about anything. He ls clueless about everything.

Tom Lynch is far from "clueless".  He ran the housing authority for several years, and I've never heard an unkind word about him.  He's probably more of what crocker's team would like to see as a town manager - somebody they can control.

Here are a couple of unkind words...

Tom lost his job at the Housing Authority after a very unfavorable state audit. He took a pay cut to "serve" as Assitant Town Manager because he needed the job. And, he's problably more in line with the Freddy Goat than Crocker. Say what you will about the Crocker Six, I think they are looking for a professional manager to replace Klimm.

I may disagree with Hank Farnham on many, many issues, but I think Hank is sensible enough to recognize the Barnstable is a business which needs a professional manager. I think everyone will be very impressioned with the selction of candidates who will step forward for Klimm's job. If Tom KLynch is the best we've got, we're in trouble.

In the wake of a coup d’etat on the council that now challenges his commitment to the self-proclaimed love of his life, Klimm is undoubtedly learning that his feeling for the town is mutual and not ripe for divorce. It has been expressed in letters of support to the editors of local newspapers and generally by the man on the street. He knows this municipal admiration is more reciprocal than one-sided.

Couple that sentiment with the notion that the 6-5 vote to offer him a bum’s rush contract with nearly $250,000 smack out of your pocket, was incomplete. The new tally, which this column finished up over the weekend by contacting the two councilors who weren’t at the meeting for good cause, is 7-6 in favor of keeping Klimm at the helm. Councilors Janet Joakim and James Tinsley each told this column they support Klimm’s tenure and would have voted for him to remain had they been there.

Even if John Klimm has regain his 7 vote majority on the council, the vote from 6/23/11 still stands. The only way it can be undone is if one of the "Crocker Six" moves to reconsider the vote. Reconsideration motions must come from the prevailing side of a council vote, I and just don't think any of the "Crocker Six" have it in them to defy Jimmy Crocker at this point.

Unfortunately John Klimm has stated that he will not stay with a council split 7-6. He has stated he needs a 2/3 majority or 9 votes in order to be an effective town manager. The last time a town manager tried to work with a deeply divided council it was Warren Rutherford. At the time the council had just eleven members and was split 6-5 in Warren's favor. Klimm's initial response was as you say, but he's gotten overwhelming response from the VOTERS, who pay the bills.  Read Al Johnson's letter - he says Klimm will continue to serve - His departure will not stop the council divide.  It'll just piss off the cherrygoat camp.  Taxpayers don't want to buyout Klimm's contract and then pay some novice to step in for another 6 figure salary.  It's stupid.  Change the charter or wait until 2015, when the TM's contract expires.

If the State Inspector General does ever happen to investigate Klimm and his past shenanigens from the water company purchase back in 2005 and they DO by chance find any 'improprieties', let's say, all this crap right now will be the very least of Klimm's problems. And quite honestly I happen to believe and agree with Gary Lopez and I have my own personal evidence of some possible real bad wrongdoings. Let it suffice to say that Klimm might wish he had never been this town's manager. Time will tell and I have my own predictions and feelings which i will keep to myself right now. Having said this, I sent in a couple letters today to the papers. Let's see how 'balanced' the Patriot and Enterprise are as these letters are NOT in support of Klimm the CLOWN!

The "Crocker Six" gave John Klimm the option to consult with his own attorney on this matter so they left themselves open to the possibility of being sued if they violated the terms of the contract buy out. Based on the aritcle in the Barnstable Patriot that seems to be the case at this point. There is also talk that the "Crocker Six" no longer agree with terms they negioated with John Klimm.
